Chai Sheshe is a tea brand operated by Elite Exchange, Mombasa, Kenya. Throughout this policy, “we,” “us,” and “Chai Sheshe” refer to Elite Exchange trading as Chai Sheshe. This policy is written to align with the Kenya Data Protection Act, 2019.

Orders and account data

When you place an order, we collect your name, email address, phone number, delivery address, and order details, in order to process, fulfil, and deliver your order. We do not store your full card or M-Pesa details ourselves, these are processed directly by our payment provider. This data is processed under contract, since it is necessary to provide the goods you have purchased.

Comments

When visitors leave comments on the site, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Contact forms

Information submitted through our contact form is used only to respond to your enquiry, under contract or legitimate interest.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

Who we share your data with

We share order and delivery information with our payment processor and delivery partners, solely to complete and fulfil your order. We use third-party service providers for email delivery and website hosting. Some of these providers may process data outside Kenya. Where this occurs, we take reasonable steps to ensure your data is protected to a standard consistent with the Kenya Data Protection Act, including relying on providers with their own data protection safeguards and certifications. We do not sell your personal data to any third party.

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time, except they cannot change their username. Website administrators can also see and edit that information.

Order and transaction data is retained for as long as necessary to comply with Kenyan tax, accounting, and consumer protection laws, generally up to seven years. Contact form enquiries are retained for as long as needed to resolve your enquiry, and are deleted or anonymised afterward where no longer needed.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Under the Kenya Data Protection Act, you also have the right to be informed of how your data is used, the right to request correction of inaccurate data, the right to object to processing based on legitimate interest, and the right to lodge a complaint with the Office of the Data Protection Commissioner if you believe your data has been mishandled and we have not resolved your concern directly.
